• i haven't shaved in 4+ days so i look like a drag king.

well you see, i have this scenario. i was parked on the the street, & it was totes legal, but some bitch hit me on my passenger side. like, t-bone style. like;


except i was parked.

anyways, so the bitch hits me, comes inside & is all "oh, i'm sry, i'll pay for it." & it's not ~that~ bad, but it's noticable, so i just let it go.

so, a month or so passes by & i get a call from my insurance company saying that the above-mentioned bitch called her insurance company & claimed that i hit her & that she needs her bumper to be fixed.

needless to say, i'm not pleased about this.

&, me being 20/m/cincy w/ a bad rap, my insurance is already high enough, & this'll most likely either get me paying $200+ a month, or just dropped altogether.

so basically, my question is, since i didn't claim it in the first place, do i have a chance to fight it legally, or should i just kill her?

or do you just not do traffic law?

i woke up at 2pm...I feel like a sore loser coz of it. my head pounds from the oversleeping.
I have exactly two exams to study for this weekend, and I better get it done. so I'm locking myself in my house, with coffee, and nachos(coz eating motivates) and this laptop, so I am positive I'll do everything to avoid real study= ill post on KR. so I'll make an effort for the good of this collectivity. do the same.

well in my defense, i actually did have productive things to do. but the center is shut down today because of the snow, along with the two classes i had. & work tonite is a no-go because i let some new girl take my shift so she could train.

basically, i should be revelling in this free time but i feel like there's something missing.

In a quick nutshell answer, you won't have to personally fight the claim if one is made. Here's why:

No ambulance chaser would ever take her claim in the first place. And if she tries to claim thru her insurance co. for property damage, your INSURANCE COMPANY has its own defense attorneys who will defend the claim. So, don't kill her. Bitch ain't worth it.

OK....I take it that no police report was made. If one was, it would be a slam-dunk that she hit you; (Usually in traffic incidents, a Police report is the first thing that is used to determine fault). This bitch is taking advantage of that factor.

Usually when one party files a claim against another and insurance is involved, the insurance will defend the claim and you have no say over what happens. They have investigators and shit that, in this case, would EASILY make this claim go away.

These companies are the devil. Their main goal in life is NOT to pay for anything. The fact that she waited to file anything makes her claim very suspect...your company will probably jump right in and refuse to pay. You may have a shot at nothing happening to you if they pay no money for this claim. It really depends upon the insurance company.

i'm with allstate, & they're not quite fond of me atm, if ever.
& she's on progressive(?) i think, & has a usually good record, seeing as she never drives (hm, well i wonder why).

& no, no police report was made. i was hoping that my insurance company would see how shady it is how she waited so long to claim against me, but they said they'd let me know what's going on with it. so basically i shouldn't even really worry about it because it really is as ludicrous of a claim as it sounds? or will they use my already tarnished driving record against me & make me out to be the bad guy?

that's actually my real dilemma here. i would go out, but i hate the cold so much. & its sleeting rain/snow/ice here. just an obvs no to going out. i don't even wanna walk to the corner store to get some grippo's, but i think i'm going to have to here in a second.

We're with Allstate too. I HATE Insurance companies for whatever that's worth, but like I said, if there is a claim to be defended, they'll defend it. They have their own investigators and they are contracted with Defense Attorneys who will handle it. If they try to duck out of this, let me look at your docs if you want.

I just think that this claim is so obviously bogus (their investigators should be able to see by the nature of the dents, etc.) that you should not be penalized. I don't think they could use anything in your past to apply to this isolated incident. That doesn't even make sense.

If I may suggest something, take a look at Geico if Allstate jacks up the premium or cancels you.

(Also, circumstantial evidence, like he was parked near his house where he probably always PARKS, and she probably doesn't!) I mean cars don't just get up and ram themselves into people's bumpers while they're parked.
