| | I think the judge is saying that she agreed but yes, was exploited. Quote: |

| | | yeah i think the judge's comments reflect that while she does recognise that consent was probably given, by the same token as a minor that consent basically means shit and that she was taken advantage of. the judge wasn't like, ZOMG, SHE WAS ASKING FOR IT. THAT TEN YEAR OLD WHORE. that said, i don't really agree with her.
white girl? oh wow. shitstorm.

| | | btw, i meant white girl with white men. i wonder how much the leniency is to do with an attitude of "well aborigines do this stuff", if so it's curious that government is on one hand making a big bruhaha about aboriginal child abuse while on the other the judiciary is kind of condoning it
if so it's an interesting (and fucked up) mindset

| | | i dont quite see where the consent bit comes into it, she's ten, i don't think she is really capable of giving consent to that, so why is it taken into consideration? i mean, okay, they didnt hold her down, but still
kesh raised an interesting point |

but i'm totally guessing

| | | laws for juvenile crime and offenders are different to the laws for adult offenders. before you start getting off your bike, the sentencing remarks should be read in full context of the facts and the circumstances.

and a 28 and 26 year old were involved ffs |

a judge is accountable for decisions made by him/her. do you honestly believe that the judge would make that kind of decision/remark in that context? a judge, of all people, udnerstands the concept of the age of consent, better than you, i or most lay people. that judge would have had the benefit of the DPP making lengthy submissions on the offence, lengthy submissions by each defence counsel for mitigating circumstances as well personal circumstances. you haven't read those transcripts.
legislation for young offenders has a different purpose than leglislation for adult offenders. they are dealt with differently UNLESS and UNTIL an application is made for them to be sentenced/put on trial as adults (generally for the gravity and nature of the offence) - its not clear whether that happened in this case.
its not even clear what the sentences were for the adults. all it says is that they haven't spent time in jail.
