Moussaoui Asks to Withdraw Guilty Plea

ALEXANDRIA, Va. - Convicted Sept. 11 conspirator Zacarias Moussaoui says he lied on the witness stand about being involved in the plot and wants to withdraw his guilty plea because he now believes he can get a fair trial.

In a motion filed Friday but released Monday, Moussaoui said he testified March 27 he was supposed to hijack a fifth plane on Sept. 11, 2001, and fly it into the White House "even though I knew that was a complete fabrication."

A federal court jury spared the 37-year-old Frenchman the death penalty last Wednesday. On Thursday, U.S. District Judge Leonie Brinkema gave him six life sentences, to run as two consecutive life terms, in the federal supermax prison at Florence, Colo.

At sentencing, she told Moussaoui: "You do not have a right to appeal your convictions, as was explained to you when you plead guilty" in April 2005. "You waived that right."

She said he could appeal his sentence but added, "I believe it would be an act of futility."

Moussaoui's court-appointed lawyers told the court they filed the motion even though a federal rule "prohibits a defendant from withdrawing a guilty plea after imposition of sentence." They did so anyway because of their "problematic relationship with Moussaoui" and the fact that new lawyers have yet to be appointed to replace them.

he was sentenced primarily on a charge he pleaded guilty to. i can't understand why everyone hasn't picked up on this.

he wasn't convicted as being guilty, he plead guilty meaning the need for a conviction was bypassed. there wouldn't have been a guilty conviction if he hadn't plead guilty. he is a nutjob that narrowly escaped a death sentence. how the fuck is that justice?

yes, he was al qaey'da. but this sept 11th stuff, even al qaey'da leaders have been laughing at this link and calling him a nutjob.

i'm not sure what is more unbelievable - the things this guy comes out with or that declaring that you're locking a nutjob up in a small room on his own for the rest of his life, as opposed to killing him instead, is justice.

What the hell, give him a trail. I don't think the outcome would be much different. But I think we could force open issues on 9-11 that haven't been answered.

The release of government information is the exact reason why, he will never be allowed to get his guilty plea overturn.

I would love to see Bin laden captured, he won't be put on trial for the same reason. But he won't stand trial for this reason. IF these trials did take place, every moment of them should be televised. We have O.J.'s televised. Ever damn moment of Clinton's blow job was made public.
